Contracts and Their Execution: The Agreement

A contract is a legally binding agreement between two or more parties. While oral agreements may be enforceable, they are more difficult to prove, so we recommend that ALL contracts be in writing.

A legal contract must contain the following elements:

  1. An Offer.

  2. Acceptance of the Offer.

  3. Consideration for each party (Consideration can be money, a product, or a service.).

  4. Capacity or Authority. Signers must be competent, of legal age, sound mind, and have legal authority.

  5. Time Element (When must the elements of the contract be met?).
