Part I of the RIPA, entitled ‘Communications’, contains two chapters that are of considerable importance to data protection laws. Chapter 1 is titled ‘Interception’ and Chapter 2 is titled ‘Acquisition and Disclosure of Communications Data’.

Part 1 of the RIPA impacts upon the requirements of Article 15.1. of the DPEC, which, to recap, allows Member States to overcome some of the protections of subscribers and users where that is a necessary measure within a democratic society, particularly confidentiality of communications and retention of traffic data.
