9.1 Despite the good intentions of both parties at the outset of a contract, breaches of contract sometimes occur. Some breaches are mere technicalities; some are more serious, although it may be difficult to substantiate damage (e.g. failure to provide a master programme to time); some are so serious that they go to the root of the contract.
9.2 Building contracts usually have express provisions to deal with certain foreseeable situations which might otherwise be breaches. For example, failure to give possession of the site can be dealt with under deferment (cl 2.5), failure to provide information at the agreed dates can be dealt with under extensions of time (cl 2.28), and imposing new restrictions on the contractor’s working ...
