HIPAA, HITECH, and state law require the execution of specific legal documents that include patient authorization forms, court orders, and specific contracts, such as a business associate contract. Some of these documents existed prior to HIPAA, and some are creatures of HIPAA. It is important that healthcare organizations (covered entities, business associates, vendors marketing products that will be used to store, manipulate, and disclose PHI), and those working in the healthcare field understand what legal documents are required and when they are required.
