Abstract
To understand the problems associated with the parliamentary mandate, it is necessary to bear in mind the complexity of the dynamics of representation as it has developed in the history of Western institutions. Within this development, one can recognize (1) an influence of the private law that correlates with the idea of the representative as an agent and (2) an influence of the public law that refers to the idea of ‘making present’, of embodying a transcendent reality (e. g.
