IV. BURGLARY
Of major interest to the security industry is the crime of burglary, a crime whose felonious
intent may be oriented toward property, but always requires illegal entry into a domicile or other
structure. Below is the traditional, common law denition of burglary—such crimes are now
dened statutorily.
1. The premises must be the dwelling house of another.
2. There must be a breaking of some part of the house itself. The breaking can be construc-
tive, as well as actual.
3. There must be an entry. The slightest entry of a hand or even an instrument sufces.
4. The breaking and entering must both be at night, but need not be on the same night.
