IV. BURGLARY
Of major interest to the security industry is the crime of burglary, a crime whose felonious
intent may be oriented toward property, but always requires illegal entry into a domicile or other
structure. Below is the traditional, common law denition of burglary—such crimes are now
dened statutorily.
1. The premises must be the dwelling house of another.
2. There must be a breaking of some part of the house itself. The breaking can be construc-
tive, as well as actual.
3. There must be an entry. The slightest entry of a hand or even an instrument sufces.
4. The breaking and entering must both be at night, but need not be on the same night.
