Background

Dealership’s customer, who refused to return vehicle or to pay amount allegedly due on sales transaction, brought civil action for assault against dealership and dealership’s employee, who fired pistol at vehicle’s tires in effort to repossess vehicle while customer was operating vehicle. Following a jury trial, the McCracken Circuit Court entered judgment in favor of customer. Customer appealed, and dealership cross-appealed. The court of appeals reversed. The supreme court granted discretionary review.
