5 Identify and discuss key employment laws pertinent to compensation practice.
The federal constitution forms the basis for employment laws. The following four amendments of the Constitution are most applicable:
Article I, Section 8. “The Congress shall have Power . . . to regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes . . . .”
First Amendment. “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”
