Many laws guide the design and implementation of discretionary employee benefits practices. In Chapter 2, we reviewed the relationship between core compensation and the National Labor Relations Act, the Fair Labor Standards Act, and key antidiscrimination laws such as Title VII of the Civil Rights Act of 1964. These laws also have bearing on discretionary benefits practice in a more general way. Here we review additional key laws that influence discretionary employee benefits practice: the Internal Revenue Code (IRC), the Employee Retirement Income Security Act of 1974 (ERISA), and the Pension Protection Act of 2006.
