CHAPTER 9: OTHER RELATED LAWS – MAINTAINING CUSTOMER RECORDS

There are rules in California statute that govern the maintenance and disposal of customer records. Although the overlap with those laws is somewhat confusing, they should be noted as they cover many of the same or similar topics.

For example, there are rules that apply to third parties that use personal information for direct marketing, and they are substantially similar to the “right of access” rules. Here, the rules apply to:

A “business” which has “an established business relationship with a customer”; and …

The business disclosed personal information to third parties within the preceding calendar year; and …

“the business knows or reasonably should know that the third parties ...
