All About Trademarks
The primary function of a trademark is to indicate the origin of a product or service; however, trademarks also guarantee the quality of the goods bearing the mark and, through advertising, create and maintain a demand for the product. Trademark rights are acquired only through use of the trademark; this use must continue if the rights you can acquire are to be preserved.
Registration of a trademark in the USPTO does not in itself create or establish any exclusive rights, but it is recognition by the government of your rights to use the mark in commerce to distinguish your goods from those of others.
