Negotiation as Part of the Lawsuit

All of the negotiation you’ve gone through before you decided to file suit is going to be repeated as part of the suit. As discussed in Chapter 19 on mediation, and also in Chapter 8 on the process of lawsuits, you’re likely to be required to participate in some form of assisted negotiation at an early point in the process.
Don’t be surprised if suggestions you made during your informal negotiations are made again, and even accepted. Sometimes, having the reality of the time and money of a lawsuit in front of a person makes him rethink things he previously didn’t want to consider.
