When Should I Use Small Claims Court?

Ask yourself the following questions to see whether small claims court is the right place for you to go:
• Have you tried to settle the dispute?
• Is it not worth it to you to hire an attorney?
• Are you willing to go it alone without an attorney?
• Are you willing to limit any monetary recovery to the amount allowed by your local small claims court?
If you answered “yes” to those questions, next check to see what the monetary limit is in your state (see Appendix B for a list). Small claims courts tend to have monetary limits from a few thousand dollars to $25,000 or more.
