Why do the courts let someone start a lawsuit for something that’s clearly stupid? It has to do with the American belief in the importance of access to justice. Everyone is entitled to approach the court for anything. There is no prescreening process to keep some people or claims out. Because of this, the court can’t immediately determine whether the claims made are pointless or not. The court has to examine every case that’s filed on an individual basis. The court doesn’t really begin that examination until the other side, the defendant, responds to the plaintiff’s claims.
