5.1. Overview of Privacy, Publicity and Defamation Laws

In a privacy, publicity, or defamation action, a defendant causes personal harm to an individual. This makes privacy, publicity, and defamation distinct from copyright and trademark. Copyright and trademark actions concern a violation against someone’s personal property - albeit intangible rather than tangible property.
