22.1. Are You Using the Song, the Sound Recording or Both?

When you want to use music, you must first determine whether you want to use the song, the sound recording or both. Your answer determines from whom you must seek permission.

Copyright law protects music. Every recorded song has two distinct copyrights. There is a copyright in the song which is comprised of the melody and any accompanying lyrics. There is a separate copyright in the sound recording. The sound recording is the recorded performance of the song.
