For establishing offshoring operations, generally three legal structures or approaches exist: (1) offshoring to a third party for services; (2) offshoring to a subsidiary after establishing it in the required country where services need to be performed; and (3) “build—operate—transfer” (BOT) model (i.e., offshoring services to a third party with an option to suitably acquire the service operations later on).
