Legislation around digital marketing suffers from the same problem that had besieged lawmakers and institutions in all other instances of sudden technology change. The arrival of the Kodak personal camera technology in the 1880s created privacy concerns that did not exist before, when legions of professional and amateur photographers suddenly took to the streets and started snapping pictures with and without permission. The pattern would repeat itself with the arrival of the radio first and TV later. These technology changes created new privacy concerns that fell into a legal void, and legislators then had to build a framework to protect individuals in a reactive manner, not a planned, proactive one.
