INTRODUCTION
Data protection law has been around in the UK since 1984. However, the requirements around data protection have been given greater prominence due to the advent of the EU General Data Protection Regulation 2016/679 (‘GDPR’) and the Data Protection Act 2018.
The GDPR is based on its previous incarnation – the Data Protection Directive 1995/46/EC (‘the Directive’) – but is more prescriptive and comprehensive. The GDPR has applied across the EU (and in the UK as a member of the EU) since 25 May 2018.
