Introduction

Unlike court proceedings where the parties have no say in the selection of the judge, parties frequently have the ability to choose or provide input into the choice of the arbitral tribunal. The tribunal shapes the process. Choosing the right tribunal for the particular matter is therefore very important. It is a decision that has to be taken early on as it usually accompanies the initial request for arbitration (see chapter 7 pages 49–51). This chapter considers these issues under the following headings:

• choosing the tribunal;
• the ten criteria for nominating an arbitrator;
• finding out about English arbitrators; and
