Judicial Accountability

The Judiciary holds an exalted position in the minds of most Indians, despite the lengthy corridors of justice. The presence of a strong and well-developed judicial system differentiates India from many of the emerging economies. This chapter examines the functioning and weaknesses of the key mechanisms enforcing accountability in the Judiciary. The matrix in Figure 7.1 lists the key internal, horizontal and external accountability mechanisms in the Judiciary. We assess these existing mechanisms to determine their ability to reinforce the four foundations of accountability.
