Definition of Contracting Authorities

The directive only applies where the procurer is a contracting authority and for this reason its definition is of great importance. The directive contains two categories:

  • Public authorities.
  • Bodies governed by public law.

A contracting authority can also be made up of several elements of either variety. Indeed there are many contracting authorities that buy on behalf of other authorities, eg by setting up frameworks such as Shared Business Services (SBS) Project Management and Full Design Team Services (PM & FDTS) or the NHS ProCure21+.
