The “Law of the Land,” Insurance Tax Reform, and the November Surprise

The end of 2016 left hordes of pundits and political scientists to explain why thousands of polls turned out to be wrong on November 8, as President Donald J. Trump emerged victorious in the Electoral College while losing the popular vote to Hillary Clinton. The November elections and ensuing efforts to “repeal and replace” the Affordable Care Act (ACA) are not likely to dramatically affect group health plans and private exchanges “for the foreseeable future.” Still, the success or failure of the ACA repeal-replace efforts deserves our interest, attention and focus.
