Inevitably, if you, as a product vendor, are involved in an equipment financing transaction, you will, at some time, be involved in a customer bankruptcy proceeding. So, an understanding of the bankruptcy rules is essential. This chapter will examine the basic provisions of the federal bankruptcy law (the law under which most bankruptcies are handled), known as the Bankruptcy Code. The Bankruptcy Code is embodied in Title 11 of the U.S. Code. An examination of similar state laws will not be addressed because they are rarely encountered in an equipment lease or financing situation.
