Export Controls and Licenses

A. Introduction

The export control laws of the United States had languished for many years without review. In fact, the Export Administration Act of 1976, which established some of the primary export control statues actually expired in 2001 and was never renewed. Every year since then the President declares a state of emergency in order to use the power vested in him under the International Emergency Economic Power Act (IEEPA) to continue to enforce the export control regulations under the Export Administration Act. Although that is one of the primary statutes, export control regulations reside in a multitude of agencies.
