CHAPTER 44ARCHITECT-ENGINEER SERVICES

The procedures for selecting a source for architect-engineer, or AE, services are described in FAR Part 36, not in FAR Part 15. While AE acquisitions are considered to be competitive for the purposes of the Competition in Contracting Act, competing contractors for AE services do not normally compete on cost, only on non-cost factors. These procedures are based on a law commonly referred to as the Brooks Act, which seeks to make sure that quality AE services are acquired at a fair and reasonable cost, instead of merely acceptable services being acquired at a lower cost.
