Ownership, privacy, and related issues
Abstract
The ethical rules that govern record ownership, privacy, and confidentiality were originally formulated with respect to paper-based records. They acquire new parameters in the case of EHRs. The increase in the diversity of individuals and institutions involved in originating and handling EHRs further expands the ethical framework in which EHRs are situated, as does the increase in what is contained in the records—genetic data, familial data, etc. Given their electronic nature, electronic formatting and encoding also assume ethical significance—something that finds no real parallel with paper-based records. The present chapter explores how and why this is the case.
