IRCA—IMMIGRATION AND REFORM CONTROL ACT

This act, originally passed in 1986, provides penalties to those employers who knowingly hire illegal aliens. The act makes it illegal to discriminate in hiring or terminating on the basis of citizenship or national origin. It also requires the completion of I-9 forms (proof of citizenship or right to work) within 72 hours of hire. Proof of identity (i.e., a birth certificate, driver’s license, a Social Security card, or immigration papers) must be supplied, and more than one item is required to prove legal working rights.
