Amended Federal Rules of Civil Procedure (FRCP) In December 2006, the United States Federal Court System announced amendments to the Federal Rules of Civil Procedure (FRCP). The amended rules govern the discovery of “Electronically Stored Information” (ESI), which refers to email, blog posts, public and private social networking content, videos, photos, and all other data that can be stored electronically. Enforced by the United States Supreme Court, the revised rules make it clear that all ESI is subject to e-discovery (may be used as evidence for or against your company) in civil lawsuits filed in federal court.
