Appendix AAlphabetical Listing of Legal Issues

Affirmative Action Plans (AAPs)

All federal contractors and subcontractors who have at least 50 employees and designated monetary levels of government contracts or subcontracts must prepare and update annually two or three affirmative action plans (AAPs). Each AAP has specific requirements dictated by regulations. The three potential AAPs are:

  1. Executive Order 11246 AAP

    Covers women and minorities and is required for each establishment, if a supply or services contractor (or subcontractor) has 50 or more employees and a government contract (or subcontract) of at least $50,000. Federally assisted construction contractors, however, do not prepare traditional EO 11246, but have 16 equal employment opportunity (EEO) and affirmative action (AA) specifications that they must meet and document.

  2. Vietnam Era Veterans' Readjustment Assistance Action (VEVRAA) of 1974, as amended, 38 U.S.C. 4212 AAP

    Covers protected veterans and is required for each establishment, if a government contractor (or subcontractor) has 50 or more employees and has a government contract (or subcontract) of at least $150,000. Federally assisted construction contractors must also prepare the same type of AAP. The categories of protected veterans are: disabled veteran, recently separated veteran (three-year period), active duty wartime or campaign badge veteran, or an armed forces service medal veteran.
