Justice Potter Stewart, in obscenity case of Jacobellis v. Ohio, 378 U.S. 184 (1964). Stewart wrote that “hard-core pornography” was hard to define, but that “I know it when I see it.” He later recanted this view in Miller v. California, 413 U.S. 15 (1973), in which he accepted that his prior view was simply untenable.
