Justice Potter Stewart, in obscenity case of Jacobellis v. Ohio, 378 U.S. 184 (1964). Stewart wrote that âhard-core pornographyâ was hard to define, but that âI know it when I see it.â He later recanted this view in Miller v. California, 413 U.S. 15 (1973), in which he accepted that his prior view was simply untenable.
