Terms and Conditions for O’Reilly Conferences and Live Events

The following terms and conditions apply to your participation in O’Reilly Conferences and Live Events (“Live Event(s)”) produced by O’Reilly Media, Inc. (“O’Reilly”). By registering for a Live Event you agree to adhere to and be bound by these terms and conditions (the “Agreement”) as well as the O’Reilly Terms of Service.

After conclusion of the Live Event, you will be provided with access to a recording of the Live Event for no less than 30 days. For avoidance of doubt, access to and use of any Live Event recording is subject to the terms of this Agreement.

1. Registration and Payment; Refund Policy

Individuals who wish to attend a Live Event must register and pay in advance using the appropriate online forms.

Payments are non-refundable, except as set forth in Section 3 below.

2. Data Privacy

By registering for the Live Event, you acknowledge that O’Reilly will collect, process and use the personal data that you provided during the registration process (“Registration Data”) in accordance with our Privacy Policy, which is available at https://www.oreilly.com/privacy.html. By registering for the Live Event, you acknowledge that you have read our Privacy Policy and that you understand and agree that your personal information will be used and processed by us in accordance with our Privacy Policy.

In addition, O’Reilly may contact you via email in order to provide information on future Live Events and similar O’Reilly products and services. You may opt out of such future communications by following the instructions provided with the emails we send.

3. Event Cancellation and Postponement Policy

O’Reilly reserves the right to cancel and/or reschedule a Live Event wholly or in part in case of an insufficient number of registrants, program cancellations, organizational reasons, changes of availability of presenters, force majeure or other unforeseeable events that would interfere with the execution of the Live Event or that would lead to O’Reilly incurring unreasonable expenses in executing the Live Event. If O’Reilly cancels a Live Event, O’Reilly’s sole responsibility to you will be to provide (i) notice of the cancellation; and (ii) a full refund of the Registration Fee paid by you for the cancelled Live Event.

You acknowledge that O’Reilly, in an effort to provide the best possible event experience, may occasionally reschedule a Live Event. O’Reilly will endeavor to provide registered event participants with notice of any rescheduled Live Event as far in advance as possible. Within ten (10) days following the date of such notice, you may request a refund of the Registration Fee paid for the Live Event by contacting O’Reilly at or visiting the O’Reilly Support Center. If O’Reilly does not receive your request for a refund within 10 days of our notice, your fee and registration will be applied to the rescheduled Live Event and no refund will be available.

Other than as specified herein, purchases of Live Event registrations may not be transferred, refunded or exchanged.

4. Content Use and Ownership

You acknowledge that registering for, attending, and/or accessing recordings of, a Live Event do(es) not transfer to you any ownership or other rights in the Live Event or any content contained therein. Except as expressly permitted by this Agreement, content made available during the Live Event and any recording of the Live Event is for personal access and use only and may not be stored, reproduced, or transmitted in any form and/or by any means, including, without limitation, as input or a prompt to a machine learning or AI system, without the express prior written permission of O’Reilly. O’Reilly and its content providers reserve all rights not expressly granted in this Agreement. You may not remove or obscure any copyright or other proprietary notices that appear in the Live Event or on content accessed through it.

Live Events may include links to third party sites. The third party sites are not under O’Reilly’s control, and O’Reilly is not responsible for their contents, or any links contained in them. O’Reilly is providing these links as a convenience, and the inclusion of any link does not imply endorsement by O’Reilly.

O’Reilly may terminate or suspend any Live Event registrant’s access to the Live Event or any recording thereof in the event of any actual or alleged fraud or violation of this Agreement or the intellectual property rights of any owner of any content contained in the Live Event. Upon termination of your access, you may not attend or continue to attend the Live Event and/or must immediately cease using any recording thereof, and all copies of content or recordings of the Live Event stored by you on any hard drive or other storage device or in hard copy must be deleted or destroyed. In the event of such a termination or suspension under this Section 4, you shall not be issued a refund of your Registration Fee.

5. Warranties and Liability

LIVE EVENTS ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, INCLUDING WITHOUT LIMITATION WARRANTIES IN RESPECT OF TITLE, ACCURACY, OMISSIONS, COMPLETENESS, DELAYS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND ANY OTHER IMPLIED WARRANTIES. ATTENDANCE AT LIVE EVENTS AND USE OF RECORDINGS THEREOF ARE ENTIRELY AT YOUR OWN RISK.

NEITHER O’REILLY NOR ITS SUPPLIERS WILL BE LIABLE FOR ANY SPECIAL, INCIDENTAL, PUNITIVE, INDIRECT, OR CONSEQUENTIAL DAMAGES (INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST PROFITS OR LOSS OF CONFIDENTIAL OR OTHER INFORMATION) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OR INABILITY TO USE LIVE EVENTS CONTENT, INLCUDING ANY LIVE EVENT RECORDINGS, EVEN IF O’REILLY OR ANY SUPPLIER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF SUCH DAMAGES, THIS LIMITATION MAY NOT APPLY TO YOU.

SUBJECT TO THE TERMS OF SECTION 6 OF THIS AGREEMENT, YOUR SOLE AND EXCLUSIVE REMEDY AND THE ENTIRE LIABILITY OF O’REILLY AND ANY OF ITS SUPPLIERS UNDER THIS AGREEMENT ARE LIMITED TO REFUND OF THE PAYMENTS MADE BY YOU FOR THE LIVE EVENT.

Under no circumstances shall O’Reilly or its suppliers be liable for any delay or failure in performance resulting directly or indirectly from acts of nature, or other causes beyond its reasonable control, including, without limitation, Internet failures, telecommunication equipment failures, fires, floods, etc.

6. Conduct

At O’Reilly, we want Live Events to be safe and productive for all participants. To that end, we expect Live Event attendees to conduct themselves with the same level of consideration O’Reilly requires from all of its event attendees under the O’Reilly Events Code of Conduct.

7. Miscellaneous

Registration fee payments are made via Stripe Payments Services. Your use of the Stripe products and services are subject to the Stripe Privacy Policy and Consumer Terms of Service.

This Agreement is governed by the laws of the State of California applicable to agreements made and performed there by California residents.

This Agreement, including the Terms of Service, Privacy Policy, and O’Reilly Events Code of Conduct incorporated herein, is the final, complete, and exclusive agreement between you and O’Reilly relating to the Live Event, and content accessed via the Live Event, and it supersedes all other oral or written communications, proposals and representations with respect to any subject matter covered by this Agreement. If any provision of this Agreement is held to be invalid or unenforceable, the other provisions shall continue in full force and effect.
