Obtaining Cost or Pricing Data

This chapter is based primarily on FAR 15.403, Obtaining Cost or Pricing Data. People who do cost and price analysis need to understand the regulatory requirements for obtaining cost or pricing data and the safeguards which are a part of those regulations.

The requirement for obtaining cost or pricing data originated with the passage of Public Law 87-653, the Truth In Negotiations Act (TINA) in 1962. The law is fairly simple. TINA requires the contractor to: 1) submit cost and pricing data showing the facts and judgements used to arrived at the proposed price; and 2) certify that the data are current, accurate, and complete at the time agreement is reached on price.
