Inventorship
Inventorship is not a criterion for invalidating a patent in Europe, but it
is in the United States.
In Europe any natural person, company, or organization can apply
for a patent under Article 58 of the European Patent Convention (EPC).
EPC Article 60 refers to the inventor to whom a patent “can” be granted,
but states that it is actually the applicant who is deemed to have the
rights. Nevertheless, the inventor has the right to be mentioned on the
patent and the moral right of paternity (EPC Article 62), but s/he can
