Requirements
There are some differences between US and EPC requirements for a
patent, as shown in Table 2.4. The subtle differences are important when
preparing a patent application, but are considered to be very similar/
identical under Article 27 of TRIPS. “Specification” relates to the fact
that the invention needs to be written in detail and must be mature (in
the best possible way). The level of detail is also important in Europe
(EPC Articles 83 and 84). “Utility” in the United States and “industrial
applicability” in Europe are often referred to as “being commercial”.
