Bisher hatten Sie Gelegenheit, sich in dreizehn Kapiteln eingehend mit verschiedenen Facetten des BGB zu befassen. Oder, um bei den Ausführungen im zweiten Kapitel dieses Buches anzuknüpfen: Sie kennen jetzt eine ganze Menge. Die »13« soll natürlich keine Unglückszahl sein. Daher erfahren Sie in diesem (und im folgenden) Kapitel mehr dazu, wie Sie das Erlernte im Rahmen einer Fallprüfung konkret anwenden können. Denn die juristische Arbeitsweise erschöpft sich nicht darin, abstraktes Wissen anzuhäufen. Im Gegenteil geht es vielmehr konkret darum, die Erkenntnisse im Rahmen der Falllösung auch umzusetzen.
Regelmäßig ist ein juristisches Gutachten zu erstellen. Dafür hat sich eine Arbeitsweise herauskristallisiert, die manchmal auch »Falllösungstechnik« oder »Methode der Fallbearbeitung« genannt wird.
