Secret Commissions as a Criminal Offense—Case Example
This example involves the use of corrupt payments to acquire a trade
secret. The scheme began with an employee of a telecommunication
company engaging an agent in another country at the direction of
the company’s senior vice president. An e- mail between the employee
and the senior vice president set out that funds were to be transferred
to the agent to pay an ofcer of a competitor, once a specic trade
secret was delivered to the agent.
The agent traveled to a third country to meet the ofcer near his
