Determining whether honeypots are illegal is not a simple question. Different organizations and different countries have specific statutes and legal processes that apply. Three main legal issues of concern with respect to honeypots are privacy, entrapment, and liability
Honeypots are a relatively new technology that can capture extensive amounts of information. Even if an attacker illegally gains access to your honeypot, there may be legal issues involved, especially having to do with privacy. Hopefully, as honeypot technologies are more widely used and understood, the legal issues will be more clearly defined, both within the United States and globally.
