1. The Fair Labor Standards Act (FLSA) was passed in 1938, and its regulations remained largely unchanged until August 2004 when new regulations redefined the “white collar” exemption tests. The statute’s basic requirements are payment of the minimum wages, overtime pay for time worked over 40 hours in a work week, restrictions on the employment of children, and record keeping. The Act covers employees who are engaged in the production of goods for interstate and foreign commerce, including those whose work is closely related to or essential to such production.
