Role for Scientific Evidence
The governments have the right to take SPS measures. However, they have to ensure
that these measures do not arbitrarily or unjustifiably discriminate among countries
where the same conditions prevail. Moreover, SPS measures must not be applied in a
manner which would constitute a disguised restriction on international trade. They
must be based on scientific evidence. As in the case of the technical barriers to trade
agreement, the governments are encouraged to base their measures on international
standards, guidelines, and recommendations whenever and wherever possible.
